SellsAdvantage ("we", "us", "our") operates the digital product marketplace at https://sellsadvantage.com. We are the data controller responsible for your personal information collected through the Platform.

2. Information We Collect

2.2 Information Collected Automatically

  • Log Data: IP address, browser type, operating system, referring URL, pages visited, and timestamps
  • Session Data: Authentication session tokens stored in cookies to keep you logged in
  • Referral Tracking: Referral codes passed via URL parameters to attribute signups to referrers
  • Usage Data: Actions taken within your seller dashboard (products created, AI credits used, orders received)

2.3 Information from Third Parties

  • Payment Processor: Transaction status, customer code, and subscription details from our payment gateway after you complete a payment

3. How We Use Your Information

  • To provide the Platform: Create and manage your seller account, process your subscription, display your store, deliver buyer purchases
  • To process payments: Verify transactions, calculate and track your earnings, process payout requests
  • To operate AI tools: Send your product title, store name, and keywords to the AI provider to generate content on your behalf
  • To manage the referral programme: Track referral attributions, calculate commissions, and process payout requests
  • To communicate with you: Send purchase confirmation emails, support responses, and important platform notifications
  • To improve the Platform: Analyse usage patterns, diagnose technical issues, and improve features
  • To enforce our Terms: Detect and prevent fraud, abuse, and violations of our Terms of Service
  • To comply with legal obligations: Respond to lawful requests from government or law enforcement authorities

4. Legal Basis for Processing

We process your personal data on the following legal grounds:

  • Contractual necessity: Processing required to fulfil our agreement with you — account management, order processing, payouts
  • Legitimate interests: Platform security, fraud prevention, improving our services, referral tracking
  • Legal obligation: Compliance with applicable Nigerian laws and regulations
  • Consent: Where you have explicitly provided consent, such as marketing communications (you may withdraw consent at any time)

5. How We Share Your Information

We do not sell your personal data. We share your information only in the following limited circumstances:

  • With buyers: Your store name, business name, and store description are publicly visible on your storefront. Buyer purchase records (buyer name and email) are visible to you as the seller in your orders dashboard
  • With payment processors: We share necessary transaction data with our payment gateway to process payments and subscriptions
  • With AI service providers: When you use AI generation tools, your product title, store name, and keywords are sent to the AI provider (Anthropic) to generate content. No personal identifiers beyond what you choose to include in those fields are transmitted
  • With law enforcement: Where required by Nigerian law or a valid court order, we may disclose personal data to authorities
  • With service providers: We may engage trusted third-party providers for hosting, email delivery, and platform infrastructure. These providers are contractually bound to protect your data and may only process it for our specified purposes
  • In business transfers: In the event of a merger, acquisition, or sale of assets, your data may be transferred to the successor entity, subject to equivalent privacy protections

6. AI Tools & Third-Party Providers

Our AI content generation feature is powered by Anthropic's Claude AI. When you use AI tools within the Platform:

  • The content you enter (product title, store name, keywords) is sent to Anthropic's API to generate content
  • We do not send your personal contact details, financial information, or account credentials to Anthropic
  • Anthropic processes this data according to their own Privacy Policy, which we encourage you to review at anthropic.com/privacy
  • AI-generated content is returned to us and stored in your account for your use

Use of AI tools is optional. You are not required to use AI tools to operate your store on SellsAdvantage.

7. Payment Data

SellsAdvantage does not store complete payment card details on our servers. All payment card data is handled directly by our payment processor. We store only:

  • Transaction reference numbers
  • Payment status (paid, failed, pending)
  • Amount paid and currency
  • Customer code and subscription code from the payment processor

Your bank account details (bank name, account number, account name) provided for seller payouts are stored securely in our database and used solely for the purpose of processing your withdrawal requests.

8. Cookies & Tracking

We use essential cookies to operate the Platform. These include:

  • Session cookies: To keep you logged into your seller account during your session
  • CSRF tokens: Security tokens stored in your session to protect form submissions from cross-site request forgery
  • Referral cookies: A short-lived session value to remember your referral source when you visit via a referral link

We do not use advertising cookies, tracking pixels, or third-party analytics cookies. You may disable cookies in your browser settings, but this will prevent you from logging in to the Platform.

9. Data Retention

  • Active accounts: We retain your data for as long as your account is active
  • Closed accounts: Upon account deletion, we will delete your personal data within 30 days, except where retention is required for legal compliance, fraud prevention, or resolving disputes
  • Order records: Transaction and order data may be retained for up to 7 years for tax and accounting purposes under Nigerian law
  • AI generation logs: We do not retain the content you submit to AI generation beyond what is stored in your account's product/store data

10. Your Rights & Choices

You have the following rights with respect to your personal data:

  • Access: You may request a copy of the personal data we hold about you
  • Correction: You may update your account information at any time through your seller dashboard. For information you cannot update yourself, contact us
  • Deletion: You may request deletion of your account and personal data by contacting us. Some data may be retained as required by law
  • Data portability: You may request an export of your product listings and order data in a machine-readable format
  • Objection: You may object to processing based on legitimate interests by contacting us with your specific grounds
  • Withdrawal of consent: Where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of prior processing

11. Data Security

We implement appropriate technical and organisational measures to protect your personal data, including:

  • Passwords stored using strong one-way hashing (bcrypt)
  • All data transmitted over HTTPS with TLS encryption
  • CSRF token protection on all form submissions
  • Secure, token-gated download links for purchased products
  • Access to seller data restricted to authenticated account holders only
  • Superadmin access restricted to authorised platform administrators

While we take data security seriously, no method of internet transmission is 100% secure. In the event of a data breach that affects your rights and freedoms, we will notify you and relevant authorities as required by law.

12. Children's Privacy

SellsAdvantage is not intended for use by persons under the age of 18. We do not knowingly collect personal data from children. If we become aware that a child under 18 has provided us with personal data, we will promptly delete it. If you believe a minor has created an account, please contact us at support@sellsadvantage.com.

13. Third-Party Links

Our Platform may contain links to third-party websites or services (for example, our payment processor's website). We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing any personal information.

14. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for legal, regulatory, or operational reasons. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify you by email or through a notice on the Platform. We encourage you to review this policy periodically.
